Summary
In July 2013, Mdm Y, a 55-year-old small business owner, underwent a bilateral oophorectomy at a private hospital in Kuala Lumpur to remove ovarian cysts. Shortly after being discharged, she experienced severe abdominal pain and was rushed back to the hospital. A CT scan revealed a perforated sigmoid colon, which, along with other complications such as perforations and infections, requiring her to undergo 3 additional surgeries within 37 days.
Mdm Y lived with 2 stoma bags for over a year before undergoing reversal procedures. The ordeal caused significant trauma, anxiety, and a decline in her quality of life. Once active and independent, managing two businesses and caring for her teenage daughter, Mdm Y became bedridden and required a caregiver. Her businesses suffered, forcing her to sell her mini-market to pay medical bills.
The complications stemmed from a vascular injury during her initial surgery, which reduced blood flow to her colon, causing necrotic tissue and subsequent perforations.
In August 2021, the Sessions Court ruled in her favor, ordering the defendants to compensate her for the damages.
