Usamah Ariffin bin Abdillah (suing through his father and litigation representative, Abdillah bin Ariffin) & Ors v. The Government of Malaysia & Ors [2024] MLJU 2609

Summary​

In August 2024, the Ipoh High Court awarded RM3.1 million in damages to a patient who had his right leg amputated above the knee due to negligent treatment at Hospital Raja Permaisuri Bainun (HRPB).​

On 5.1.2019, the patient, who was a minor, was rushed to HRPB’s Emergency Department after a motorbike accident that injured his right knee. On 6.1.2019, the patient was referred to HKL’s Vascular Department at 2:00 a.m., but the ambulance was delayed until 3:30 a.m., causing the patient to arrive at HKL around 6:45 a.m.​

Due to delays in diagnosing, treating and managing his condition, he developed severe vascular complications, ultimately leading to an amputation of the patient’s right leg above the knee.​

In this case, the Government admitted liability.

Compensation Received:​

RM3.1 million:- ​

  • Special Damages: RM2,687,625 > Prosthetics, long-term care, therapy, and loss of earnings.​
  • General Damages: RM150,000​
  • Aggravated Damages: RM200,000 > Failure to provide proper medical advice & suppression of medical records.
