Nur Adeena bt Mohd Syahmir v the Government of Malaysia & Ors
Summary
A child born in 2020 via Caesarean section sustained spinal cord injuries due to complications during the procedure, leaving her paralysed from the neck down (tetraplegia). An internal inquiry conducted by the hospital shortly after her birth revealed that the medical officer performing the surgery lacked experience and was unsupervised by an obstetrician or gynaecologist.
Acting on behalf of the girl, her father filed a lawsuit against the government and the involved doctors. 2 years later, the Government admitted liability, and after a trial to determine damages, the High Court awarded RM5.6 million. The Government had appealed the High Court’s quantum ruling.
In 2024, the Court of Appeal increased the damages to RM8.6 million for the child. In its decision to raise the amount by approximately RM3 million, the Court of Appeal stated that the additional funds were necessary to adapt the child’s home and transportation to her needs. The court also noted that the High Court’s RM5.6 million award was not adequately supported by expert evidence provided by the government.
