Nurul Iman Binti Abu Mansor v Gleneagles Hospital Kuala Lumpur Sdn Bhd & Anor [2024] MLJU 2386
Summary
In 2018, a 17-year-old was advised to have surgery to improve the function of her right hand due to carpal tunnel syndrome (a minor procedure to treat carpal tunnel syndrome, a condition causing pain, weakness, and tingling in the hand).
However, she suffered permanent damage to her right hand after the botched surgery. Both the patient & her father were not informed about potential risks or complications of the surgery, which were not mentioned in the consent form or medical records. The right median nerve was cut during surgery, and corrective treatment was also delayed.
Since 2018, she has undergone 8 surgeries on her right hand. Due to the defendants’ negligence, she cannot use her dominant hand and struggles with tasks requiring both hands, needing assistance with daily activities. Thus, she has permanent disability.
In 2024, the KL High Court found the surgeon and hospital negligent for not informing her of the risks.
